A female staff member who had worked for over a year was granted leave without pay before her maternity. During the approved leave period, she gave birth and subsequently applied for maternity leave from the delivery date. She had initially planned to return after her maternity leave. However, due to medical advice from her doctor, she requested additional leave, which the management did not approve, instructing her to rejoin duty. Unfortunately, she couldn't return and eventually resigned after completing her maternity leave without returning to work.

My inquiry pertains to whether she is entitled to maternity pay along with her service benefits, given that she did not rejoin the company and complete her service.

Hello, As per my knowledge, the employee is eligible to receive the salary during her maternity leave every month until the time they are employed with the company.

Hi, If your establishment is covered under the Maternity Benefit Act, then it is the employer's responsibility to provide maternity benefits. Whether the employee joins back after the maternity leave period or not is not a criterion for releasing maternity benefits.
