Hi,

As a Principal Employer, you might have already entered into a contract of agreement with the Contractor wherein there should be an indemnity clause safeguarding the interest of the Principal Employer. However, as per the law, the Principal Employer shall be held liable and responsible for all types of accidents or deaths that occur inside the establishment. The same applies in the case of default in making statutory payments by the Contractor; the Principal Employer will be held responsible.

With the contractor, you need to have a contract for service. That means you only specify the nature and quantum of the job to be done and are not involved in micromanaging the contractor's labor. You can follow the draft declaration given below:

"This is to state and affirm that the contract laborers listed in the attached sheet have been selected and deployed by the [contractor firm] by us after careful consideration of their abilities, talents, behavior, and performance. We take full responsibility for their work and conduct at the premises of [Principal employer] in pursuance of work order no. _______ dated ../../....".
