Hi, I need help. I am currently working for TCS India. I received admission for higher studies in the USA 10 days ago and have obtained my visa. I am unable to serve my notice period for more than 2 weeks. I have informed HR and my manager that I wish to avail of LWP but have received no response from HR. After 7 days, HR replied that I am not eligible as I have not completed two years, and now they are not releasing me. I submitted my resignation yesterday as I only have 5 days left. Neither HR nor my manager is responding, and I am unsure of what to do. I do not want to end up in legal issues as I have assets from clients and TCS laptops. I am unable to serve the notice period but also cannot give up on my dream of pursuing higher studies in the US. I do not believe it is legally or ethically right to serve the notice period before moving to the US. I am completely confused. Can someone help? Thanks in advance.
Hi, see if you can talk to your HR in person. Hand over all company properties to the employer. Check your separation clause in your appointment order. Request them to accept and make payment towards any shortfall notice, provided they accept. Do not leave without information that will have an impact on your career.
