Hello everyone,

Some of the workers in our factory have retired, but we want to continue their service with ESI benefits. Is it mandatory to pay the employer's ESI contribution share at the time of re-employment after retirement, or does the employee have to pay both contributions by themselves?

If you are keeping an employee in service after the retirement age, you are required to continue the coverage under the ESI Scheme as it existed. The employer's contribution cannot be charged from the employee as it would violate the ESI Act of 1948. If the contribution is charged from the employee, then it would not be considered the employer's contribution.
