I have been suspended from my private job, and a charge sheet has been issued to me. All the allegations are very nominal, such as not performing tasks that were not important at all. However, I have completed all the important work related to my portfolio. I inquired about my deducted salary and job security, and as a result, I was suspended. Now, I do not want my deducted salary and other benefits, but I wish to resign from my job. My question is, can I resign during this period? I have provided an explanation in response to my charge sheet.

Resignation of a Charge-Sheeted Employee

No, a charge-sheeted employee's resignation will not normally be accepted by an employer unless the employer is convinced that the exit of an unwanted employee is more important than the mode of exit, in order to save the time, money, and energy involved in the formal disciplinary process.

If the employee is confident about their impeccable service or conduct, they can actively participate in the disciplinary process and should disprove the charges leveled against them. Instead, if they try to resign while the disciplinary action is in progress, it would certainly be construed as an attempt to circumvent the effect of a potentially ignominious exit only.

Handling Suspension and Resignation

If you are suspended and a charge sheet has been issued to you, you cannot resign from the company. Once you have already replied to their charges, you need to wait for a minimum of 15 days and then follow up on the matter regarding its future course of action. If they initiate any inquiry, you should participate and present your point of view in writing. If they do not respond for an extended period, even after several reminders, such as more than 3 months, then you can start searching for a new job.
