Dear Concerned Authorities,

The Labour Ministry has notified section 142 of the Social Security Code 2020, which states that beneficiaries under EPFO and ESIC must link their Aadhar number to their account starting from 01.06.2021. The EPFO has issued a circular that as of 01.06.21, if Aadhar is not linked to the EPF account, employers are not permitted to deposit PF contributions for those employees. Additionally, the EPFO has implemented a filter. Consequently, this circular will immediately burden employers, potentially leading to defaults in the payment of statutory dues for employees whose Aadhar linking is hindered due to reasons that require employee initiation.

I kindly request sending an email to the concerned authorities to halt the implementation and conduct a special drive to facilitate Aadhar linking, aiding employees in correcting their details for the Aadhar seeding process.

Yes, you are right. Why should the employer pay interest on delayed payments without their fault? In many cases, instead of 100 reminders/requests, few employees are not ready to link their Aadhar. As an employer, we don't have any right to do the same. It is only the employee who can link Aadhar to UAN.

Also, in the case of a female employee who got married and changed her name, it is not possible to update the same online. It requires a physical joint declaration, which is not possible due to the work-from-home environment. Additionally, the PF department is working with only 50% staff, and they are not able to process requests in a timely manner.
