Please help! I am from a private firm and got infected with Covid-19 while performing my duties. I kept myself isolated, and after 14 days, I am okay. My RTPCR reports say negative. I also received my full salary, but the Admin head and HR adjusted all my leaves to provide me with the full salary.

Is this justified?

After knowing about the world pandemic and how we are all surviving daily, it's common for everyone. I need your comments on this and how I can save my leaves. If you have any government notifications, please share them here.

No Law for Full Salary Without Work

There is no law that grants full salary without work. An employer can choose to do so on compassionate grounds. You are fortunate that you had enough leave in your account. Last year, our Prime Minister requested all employers to consider paying during the lockdown period, but this request was challenged in the Supreme Court. The apex court has issued an order stating that employers can either consider or reject such requests from their employees. Therefore, it's a case of "No Work, No Pay."

Understanding Leave Policies During COVID-19

I totally understand that "No Work, No Pay" applies to every private firm. However, what if the CMD already stated that a complete salary should be provided to those who suffered from COVID-19? Even after his approval, they deducted all the leaves. They should have informed us about the leave adjustments.

In my reply, it is clearly mentioned that the employer is free to consider the call. You need to meet with the HR/Admin about the decision of the CMD to consider your days of absence not against the leave but rather as special sick leave. You can also bring this matter to the attention of the CMD for consideration.
