Hello Learned Members,

One ex-colleague was working in a company. The company had started COVID deductions at 25% from the April salary. After 3-4 months, he lost his job. His salary was paid to him with 25% COVID deductions. Later, he came to know that COVID deductions were discontinued from the same month he received his last salary in that company. It was intentionally done.

Labor provisions for COVID deductions

What are the labor provisions available to deal with such matters, and can the labor office, if reported, take appropriate punitive action against the company?

In the situation described, the ex-colleague's case raises concerns related to unfair deductions and potential misconduct by the company. Here are the steps and considerations to address this issue effectively:

Labor Laws and Provisions in India
- The Payment of Wages Act, 1936, governs issues related to salary deductions and ensures that deductions are lawful and fair.
- Any unjustified or unauthorized deductions from an employee's salary are not permissible under this Act.
- The ex-colleague may also refer to the Industrial Disputes Act, 1947, in case the matter escalates to a dispute that needs resolution.

Steps to Address Unfair Deductions
1. [Icon] Gather Evidence: Collect all relevant documents, including pay slips, communication regarding deductions, and termination details.
2. [Icon] Approach HR: Initially, discuss the issue with the HR department to seek clarification and resolution within the company.
3. [Icon] Send Legal Notice: If internal discussions do not yield results, consider sending a legal notice highlighting the discrepancy and seeking appropriate rectification.
4. [Icon] Contact Labor Office: If the matter remains unresolved, the ex-colleague can file a complaint with the labor office in Mumbai for further investigation.

Possible Actions by Labor Office
- The labor office may conduct an inquiry into the company's payroll practices and actions taken against the ex-colleague.
- If discrepancies are found, the labor office can take punitive actions against the company, such as imposing fines or issuing warnings to ensure compliance with labor laws.

Seek Legal Assistance
- It is advisable for the ex-colleague to seek legal counsel to understand the legal options available and receive guidance on the best course of action.

By following these steps and leveraging relevant labor laws in India, the ex-colleague can address the unfair deductions issue and seek appropriate redressal through the labor office if necessary.
