Factory License Renewal Issue

The factory license renewal application, submitted in April 2018, was showing as "under process" on the web portal until COVID-19. Suddenly, the web portal now shows the factory license renewal as rejected, with no written communication from NDMC or email regarding the rejection.

History

1. The factory has been located on the premises since 1963 under a different name, Shakti Enterprises.
2. There is an agreement from 1963 between the owner and Shakti Enterprises.
3. We have opened a new firm on the same premises named Horizon Industrial Products Pvt Ltd.
4. We have the owner's written consent on paper for the rent agreement of the same premises.

We do not have the NOC of the owner but have been running a factory with a valid license since 1963 to date. Please assist us.

Questions and Concerns

1. Should we apply for a new license? Do we need to provide details of the old license or not?
2. How can we resolve the NOC issue, which is necessary as the owner is deceased, and his sons are in India?
3. How can we renew our license as soon as possible? BSES Electricity and DEL Water are threatening disconnection. We have filed a petition in court and sent registered mail to all concerned authorities.

Factory License Renewal and Responsibilities

As per the Factories Act, the Chief Inspector of Factories is empowered to issue a factory license. According to Rule 7 of the Delhi Factory Rules 1950, it is the Chief Inspector of Factories, Delhi Administration, who is responsible for renewing the license.

Probably, you are referring to some other permission from NDMC as per the Municipal Laws applicable there. Please extract the same and post it for examination.
