Hello, I am working in a manufacturing company, and my query is: we provide the company's benefits to new employees after one year as per our policy. I just want to ask, if a previous employee rejoins after 3 months of resigning, can we apply the same policy to the rejoining employee, or is he eligible for the benefits?

No. Even if he is an ex-employee, the person left and rejoined; hence, it is a new employment. Extend all applicable benefits to him at par with a new employee.

Consider, after putting in a few months of service, he resigns again. Will you consider paying him all the benefits right from day one of his first employment?
