I just want to confirm about the bonus calculation. I have joined my present company on 14.04.2017, and today I had a word with our HR person regarding bonus calculation as I heard from my fellow employees that the calculation is confusing. So, in our discussion with HR, it has been understood that the company will calculate the bonus from the date of confirmation only and not from the date of joining. The most funny thing is the HR will provide confirmation upon their will and mind. In my case, it happened only after 6.5 months, i.e., on 01.11.2017. So kindly help me to clear the doubt of whether this practice is lawful or if an employee can demand a bonus from the date of joining itself.

Your company is wrong. The bonus entitlement starts from the date of joining and not on confirmation. If you are not covered under the Payment of Bonus Act and the company still wishes to consider a bonus for you, the company can have its own terms and conditions.
