Five months ago, one of our employees resigned. After leaving the company, she passed away. Now, her husband has come to the office asking about her PF and pension amounts. He has all the necessary documents, such as the death certificate.

Kindly guide me on how to handle and apply for his PF and EPS.

In the absence of a proper nomination by the wife at the time of employment, and since the employee is no longer alive, it is always better to ask the husband to obtain the Legal Heir Certificate and file the claim form. When settling the PF and Pension claims, PF authorities will insist on such a certificate.

Dear Ravindra,

The claim has to be filed by the legal heir in Claim Form-20 for PF amount, for pension in Form-10-D, and Form-5 IF (EDLI). In an employee's death case, use the Composite Claim Form. The following documents need to be attached with the claim form: bank details of the claimant, death certificate of the employee, legal heir certificate, AADHAR, etc., can be sent to RPFC under the signature of the employer.

Hi Prabhat Ji,

At the time of her death, she was not an employee of our company, so EDLI is not applicable to her. Am I correct? Please correct any mistakes here.

With the Form 20 and 10D, I have attached the following documents:

1) Employee death certificate.
2) Aadhar card of the employee and nominee.
3) Bank accounts of the employee and claimant.
4) Legal heir certificate (ration card and wedding photo).

For the legal heir certificate, what do we need to consider?

You are right, the EDLI is not applicable as she was not in service. Tehesildar is the authority to issue Legal heir certificate.

Since she doesn't have children, the nominee is the person who can claim PF withdrawals and EDLI. To do so, the nominee needs to submit valid documents such as the death certificate, bank details, and AADHAR. However, the nominee is not eligible for a periodical pension amount.
