We face last month very issues from apprentice candidate, there absentisem are more in a week also not do proper focus on theire work, so can we terminate him? here apprentice act will affect or not?

You can terminate an apprentice under legal notice by asking for an explanation through a letter or in-person. After receiving the explanation, if you find it is not valid, you can proceed with termination by issuing a termination letter.

Termination of Apprenticeship Contract

Under the Apprentices Act 1961, termination of an apprenticeship contract can occur by one or more of the following means:

1. The contract of apprenticeship shall terminate on the expiry of the period of apprenticeship training.

2. Either party to a contract of apprenticeship may make an application to the Apprenticeship Adviser for the termination of the contract. When such an application is made, a copy must be sent by post to the other party to the contract.

3. After considering the contents of the application and any objections filed by the other party, the Apprenticeship Adviser may, by order in writing, terminate the contract if satisfied that the parties to the contract, or any of them, have failed to carry out the terms and conditions of the contract. It must be deemed desirable in the interests of the parties or any of them to terminate the contract.
