Hi, If my company not doing full & final settlement within the timeline can I raise complain in Labour court? If yes, what is the procedure for the same?

Hi,

If you fall under the purview of "Employee" as per the Industrial Dispute Act, only then can you approach the labor department of your state for interventions. Please provide complete details for further course of action.

My payroll company is based out of Bangalore. It has been more than 30 days, and they have not cleared my Full & Final settlement. There is no mention in the appointment letter of how much time they needed to clear the F&F. However, as per the company policy, they are supposed to clear it by the 30th of each month. In this case, can I go ahead and complain in the Labour court for seeking help? How do I start the process for suing them?
