We work with a pattern of DNODNOO. ( 7 day week ) What are the rules in India that govern this. If there is a dispute of rest period due extra shift. Kindly clarify for DNOODNOO ( 8 day week )

Are you running a factory?

Prohibition of Overlapping Shifts:

Work shall not be carried on in any factory by means of a system of shifts arranged so that more than one relay of workers is engaged in work of the same kind at the same time.

The State Government or, subject to the control of the State Government, the Chief Inspector may, by written order and for the reasons specified therein, exempt, on such conditions as may be deemed expedient, any factory or class or description of factories, or any department or section of a factory, or any category or description of workers therein from the provisions of sub-section (1).

As per the Factories Act 1948, every adult (a person who has completed 18 years of age) cannot work for more than 48 hours in a week and not more than 9 hours in a day. According to Section 51 of the Act, the spread over should not exceed 10-1/2 hours. A weekly off is also mandatory.

You need to read the relevant parts of the Factories Act and amendments applicable to your state regarding working hours, shifts, etc.
