Hello Professional, I worked for one organization from 16th January 2017 to 30th April 2017. They didn't submit Form 9 and the digital certificate, and they also didn't submit KYC details to the EPF portal. I have requested many times, but they don't care and don't even reply to emails. I'm currently in Bangalore, and the company is in Vadodara, Gujarat. I cannot go to the office at the moment. I have several questions:

Responsibility for Submitting Form 9

1) Who is responsible for submitting Form 9, the employer or the employee, to the PF office?

Presence Requirement for Form 9 Submission

2) If it is the employer's responsibility to submit Form 9, is my presence needed during the procedure?

Employee's Role in Submitting the Digital Certificate

3) To submit the digital certificate, is there any work required from the employee's side?

Timeline for Digital Certificate Submission

4) How many days are needed to submit the digital certificate from the employer's side on the EPF portal?

Seeking Justice if Employer is Non-compliant

5) If the employer does not take care of the above processes, where can I seek justice?

1. Responsibility for Submitting Form 9:
- The employer is responsible for submitting Form 9 to the PF office. It is a crucial document that outlines the details of the employee's service and contributions to the EPF.

2. Presence Requirement for Form 9 Submission:
- Your presence is typically not required during the submission of Form 9 by the employer. However, it is advisable to confirm this with the EPF office or seek guidance from legal experts.

3. Employee's Role in Submitting the Digital Certificate:
- The submission of the digital certificate is primarily the employer's responsibility. As an employee, you may need to provide any necessary information or documentation requested by the employer for this process.

4. Timeline for Digital Certificate Submission:
- The timeline for submitting the digital certificate to the EPF portal can vary. It is recommended to follow up with your employer to ensure timely submission to avoid any discrepancies in your EPF account.

5. Seeking Justice if Employer is Non-compliant:
- If the employer continues to be non-compliant and neglects their obligations regarding EPF submissions, you can seek assistance from the Employees' Provident Fund Organisation (EPFO) or consult with legal professionals specializing in labor laws to address the issue effectively.
