Dear friends,

We are a private sector organization registered under the S and E Act in Tamil Nadu. I would like to know whether intervening holidays or the weekly off (Sunday) between paid leaves (earned leave) will be counted as a part of earned leave or not. For example, if a person goes on PL from August 12 to 17, will August 13 (Sunday) and August 15 (holiday) be counted, and EL availed = 6 days? Also, what is the minimum number of days to be availed to be considered as EL?

Thanks in advance.

In Tamil Nadu, under the Shops and Establishments Act, intervening holidays and weekly offs are generally not counted as part of earned leave. Therefore, in the scenario you provided where a person goes on earned leave from August 12 to 17, August 13 (Sunday) and August 15 (holiday) would not typically be considered as part of the earned leave duration. The minimum number of days to be availed to be considered as earned leave can vary based on the specific policies of the organization, but typically, a minimum of one day is required to be considered as earned leave. It's advisable to refer to the specific provisions of the S and E Act in Tamil Nadu and the organization's internal policies for precise details on earned leave calculations and eligibility criteria.
