Can someone tell me that in my concern (a jewelry shop), there were more than 5000 employees working in Chennai? The employee who had been working in this concern for more than 3 years has decided to resign. He is from Nepal. He wants to apply for PF settlement. For the PF settlement procedure, he needs to provide ID proof like PAN Card and Aadhar Card.

As he belongs to another country, how can he obtain the PAN Card and Aadhar Card for proof?

Could you please help in this urgent case?

If the establishment has shown them as a foreign employee and deposited the whole 12% of the employer's share in account number 1, then there should not be any problem. The employee can obtain a Certificate of Coverage (COC) and proceed with the settlement using the COC certificate. All verifications are completed at the COC stage itself.

Any Indian employee working or having worked abroad in a country with which India has entered into a Social Security Agreement (SSA); OR - Any foreigner working in India in an establishment where the Employees' Provident Funds & Miscellaneous Provisions Act, 1952 is applicable.

To obtain the exemption, an outbound employee requires a Certificate of Coverage (COC) from the designated agency, Employees' Provident Fund Organisation (EPFO), which serves as proof of social security contribution in India.

If a Social Security agreement assigns coverage of the employee's work to the United States, the Social Security Administration issues a U.S. Certificate of Coverage. The certificate serves as proof that the employee and employer are exempt from the payment of Social Security taxes to the foreign country.

Dear Mrs. Aishwariya,

In your post, you mentioned the boundary of Nepal, which implies it will be either in India or Nepal. If he is a Nepal resident, the establishment should send the IW status to RPFC, and the necessary documents are to be sent to RPFC. As there is no SSA with Nepal, the member cannot withdraw the EPF amount until the retirement age of 58.
