Supreme Court Ruling on Professional Activities in Residential Flats

The Supreme Court has clearly stated that only lawyers, doctors, and architects, if staying in their residential flats, can conduct professional activities in that flat using 25% of the FAR (floor area ratio). No other commercial activity is allowed in a residential flat. Therefore, coaching classes, play schools, and daycare centers operating in residential areas must close and relocate to commercial spaces designated for commercial activities.

Dear All,

I studied this judgment very carefully after posting it. This judgment gives directions to NOIDA Authority not to permit banking, nursing homes, or any other commercial activity in a particular sector in the development area earmarked for residential use. These directions are based on the by-laws and master plan of NOIDA. Hence, in my view, this judgment may not be applied outside NOIDA authority.
