I am on maternity leave for 3 months. I have asked my company to extend my leave without pay for 2 months. However, the company is refusing to extend my leave and is requesting me to rejoin immediately. If I do not rejoin, the company plans to terminate my employment. My baby is 2 months old.

Hi. Instead of that you can request management for using existing leaves & beyond that as LOP. So management may accept your request

Dear Sujatha,

In this case, I would request you to visit your employer (if you are located in the same city) and explain your situation to them.

1. If your request is due to health concerns, clearly provide them with the necessary documents that your employer will require to accept your request.

2. If your request is due to the attention you need to pay to your baby, explain your personal situation to them and try to request a Work From Home option. If they do not have such a policy, ask for extended leave without pay.

I am pretty sure your employer will consider and accept your request, but again, it all depends on how you make them understand your situation.

Hi,

When sending an official mail or letter to the company requesting an extra 2 or 3 months of leave without pay along with a doctor's certificate, they are obligated to grant it. They do not have any legal right to terminate your employment while you are on maternity leave. Please ensure you keep proof of your leave extension application with you.
