One of my friends met with an accident in the company while working. He had been working there for the past 20 years. Recently, due to a pay hike to ₹20,000, they cancelled ESI. He has two children studying in high school. I would like to know the death benefits his family would receive. If the employer does not provide compensation, whom should they contact? This guidance will be very helpful to their family.

Dear Raghu, What was his nature of employment - manual, clerical, supervisory, managerial, technical? Also, pl give an exact narration of the accident.

An accident in the workplace is assumed to occur in the course of employment and is therefore covered under the Employee Compensation Act (previously known as the Workman Compensation Act). As a result, the employee will receive compensation from the company. The exact amount of compensation depends on factors such as age, salary, etc.

Has the employee is permanent worker r temporary .. He could approach the management & tell the situation ....& tell do what best they can do for him....
