I am Ramkrishna Jamsandekar - Sr. Manager - HR. I need a clarification regarding the Gratuity Act. Under the Payment of Gratuity Act, 1972, is there a maximum age limit for gratuity? Generally, organizations set the superannuation age at 58 to 60 years. If an employee continues working after reaching 60 years, is he still eligible for gratuity beyond the retirement age, i.e., after 60 years?

Dear friends,

Even though the retirement age is fixed at 60 years in general, this can be extended in special conditions stipulated in Standing Orders or CDA Rules. Hence, an employee getting relieved from service even after 60 years is eligible if it complies with the company rules.
