I joined a Bangalore-based company in June 2014 as a BDM for the Nigeria location. The salary offered was 2000 USD. I traveled to Nigeria in July 2014. Since then, I have not been receiving my salary on time. I receive a part of my salary after many follow-ups every month. Therefore, I have decided to quit my job. I returned in March 2015 and resigned. The payment due upon resignation was 3.1L. The president mentioned that they are facing some financial crunch, so they are unable to make this payment. I agreed to accept 1.8L instead of 3.1L due to my family situation as I was in urgent need of money. They assured me that my money would be released on or before March 31, 2015. However, I have still not received it despite numerous follow-ups. They keep giving commitments but are not strict on fulfilling them. Kindly guide me on how to proceed.

Approach a lawyer who is a specialist in this field and send your ex-employer a legal notice. State that you want maximum compensation (possibly more than your pending salary - discuss with the lawyer the amount you can claim) for your mental and physical losses caused by the situation. You may also be entitled to your actual salary, which is beneficial. Don't delay; send a legal notice promptly.

It would be better to ask management once if such rules were not followed. Otherwise, you can prepare the last 3 months' payslips showing the exact salary and have your current employer sign and stamp them. Then, you can submit them to another company.
