I have some doubt regarding ESIC annual return. Can anyone guide me on whole procedure of filing ESIC annual return. Regarding PF, I enquired in EPFO (Jhilmil) & came to now that we don’t need to do anything extra for annual return. Being from employer side, we only need to submit PF monthly contribution on time, that’s it. I am just wondering about ESIC. If anyone can help then that would be really great.

I am not sure about the rules. It's the only reason I am gathering information. Currently, I work in a Pvt Ltd company, and until last year, we hired a consultant for compliance purposes. Now, I am the only person taking care of all the compliance aspects. I recall that the consultant collected many documents from us last year for the annual return. Therefore, I am a bit concerned about the same. At present, I am only submitting the monthly contributions. Do I need to do anything more regarding PF and ESIC?

It will be difficult for me to suggest to you regarding statements in respect of EPFO. However, as far as ESI is concerned, may I kindly request you to indicate whether you are depositing contributions under the ESI Act online every month?
Regarding the Annual Return under the ESI Act, please indicate if you have an office copy of the annual return that was filed or submitted by your ex-consultant/advisor. If so, kindly inform me on which proforma he has submitted the same.

Under the new system of filing the monthly contributions and returns online, there is no provision for filing annual returns either under PF or under ESIC. For confirmation, please have a look at the website of each of them. They have a FAQ section and a returns section, both of which will give you the information you need.

Due to the online system under EPF & ESI, ECR is submitted every month online. There is no need to submit the return, as mentioned on the EPF site when you log in to submit the monthly ECR. There is no need to submit any documents, and the same procedure is in ESI. All the data is clubbed automatically while filling the month-wise ECR.

Please do some basic research on your own. It helps in the long run not to depend on others for the answer always. Go to the PF website. The details of the current requirement are provided there. There is also a FAQs section where answers would be given. The same goes for ESIC. In any case, there is no provision on the portal for returns. They won't accept it by post or physically. So where will you file it?

Dear Barkha,
This is for your information that ESI returns are not annual but half-yearly. There is no need to submit the hard copy of the ESI return. If you have any doubts, please contact your local ESI Office under the coverage of your establishment. If they ask for a hard copy, then take the print from the ESI site and submit it.

This is an electronic monthly return to be uploaded by the employers through the Employer e-Sewa portal. The return will have the member-wise details of the wages and contributions, including basic details for the new and exiting members (members who have joined or have left service in the wage month for which the return is uploaded).

Thanks, Saswata. I had already done research. I was trying to understand about ESIC. I think there nothing has been given. Anyways, I enquired from ESIC officials, and now it's confirmed that we don't need to do anything apart from the monthly contribution.

By a circular dated 25.2.2015, the Employees' Provident Fund Organisation has instructed all the employers to file a return online stating ownership in Form 5A showing the particulars of all the branches and departments owners, occupiers, directors, partners, manager, or any other person or persons who have the ultimate control over the affairs of such factory or establishment. Failure to make compliance would attract 'penalty' as stipulated by Section 14 of the Employees' Provident Funds & Miscellaneous Provisions Act.
