Hi, My father was an ex-employee of BSNL and took voluntary retirement (currently deceased). He was receiving a pension from BSNL. My mother is also retired from a job in the Maharashtra state government and receives a pension from Maharashtra state.
My Questions Are:
1. Can my mother receive my father's pension after his passing, even though she already receives her own pension from Maharashtra State?
2. Are there any rules that would prevent her from receiving the pension?
3. Is it legal for her to receive both pensions?

According to me, there is no issue if your mother claims a dependent pension from your father's service and also a pension from her own service. Two pensions from two separate service spans by any person are not allowed. In such a case, both the service spans are clubbed together, and the pension is decided, as far as I know. I came across a recent judgment of Madras HC in which two separate pensions are allowed from two separate service spans of a person.
