You are not eligible for the payment of gratuity because it requires at least 5 years of service. Only in the case of death, an employee is eligible for gratuity for less than 5 years of service. According to the judgment of the Madras High Court, employees who work for 4 years and 240 days are eligible for gratuity. However, this judgment applies only to the High Court's jurisdiction, and other states are not bound to follow this ruling.
