Dear Sir,

A hospital run by a charitable trust with 150 employees has to decide whether to pay a bonus to their staff or be exempted from doing so. We are not making a profit; we provide treatment at subsidized costs, making it affordable based on economic status.

Thank you.

Dear Thomas,

In reply to your query, I would suggest you refer to Section 32(v)(c) of the Payment of Bonus Act, 1965, which excludes "the institutions (including hospitals, chambers of commerce, and social welfare institutions) established not for purposes of profit."

In view of the above, you can examine whether your hospital, which you claimed is run by a charitable trust, is considered to be in the exempted category or not.
