I want to know what to do if a company is not willing to provide a full and final settlement. I have a situation where an individual resigned and only gave a 3-day notice period. An amount of approximately Rs. 60,500 is pending in the full and final settlement. Please advise on the next steps to take.

You can raise an industrial dispute if you are a workman or file a civil suit.If gratuity is involved in the above amount you can approach controlling authority. Varghese Mathew

The employee can demand a full and final settlement only when they have completed the exit formalities on time. If there is a notice period of 30 days and you have a leave balance of 30 days or more, then request the company to adjust the leave balance in your notice period. Further, surrender all company belongings and receive acknowledgment.

In addition to Rahul's suggestions, ask for PF forms as well so that you can withdraw the amount or transfer it to your new employer. However, please ensure that you have complied with the handing-over procedure as mentioned by Mr. Banerjee.
