Hello Everybody, I am Chetan from Mumbai, India. I worked for a company for 9 months, and I resigned on 7/8/2013. My probation was for 6 months, but it was extended for a further 3 months by the company. The offer letter mentioned that I have to serve a notice period of 1 month post-confirmation.

My probation ended on 28/7/2013, and I stopped going to the office from 1/8/2013 and resigned (via email) on 7/8/2013. I didn't receive any confirmation letter from my company until 31/7/2013. Hence, I don't think that I am supposed to serve a notice period of 1 month as a compulsion.

Now, I want to know what I can do if my employer doesn't pay my full and final settlement amount. Is there any set period to complete the same?

Clarification Needed on Salary and Employment Details

Please clarify the following:

1. Is your salary structured or paid as a stipend/lump sum?
2. If it is structured, please provide the details.
3. Do you have any benefits such as Leave Salary, LTA, Medical, Gratuity, PF, etc.?
4. Have you received your salary for the month of July 2013?
5. Have you submitted your original certificates to the employers? If yes, what does your appointment letter say about unauthorized absence? There is a possibility that the employer may claim they have not accepted your resignation and could force you to continue services.

Yes, my salary was structured. It includes Basic, HRA, Additional HRA, PF, Medical allowance, and Bonus. Gratuity was also part of the CTC. I have not received my salary for July '13 as it has been put on hold. The original documents are with me. There is no notice period during probation as stated in the offer letter; however, I have to serve a one-month notice after confirmation if I decide to resign. I have emailed them again, and they have requested me to hand over my responsibilities to the relevant person at the office. I will comply with their request and complete all formalities. If they still do not release my salary and the bonus for 9 months, what should I do?

It is advisable to complete the formalities and wait for few days, even after if you are not getting your FNF then approach the forum for help

Hi, If you got confirmation letter before your resignation then you have adhere to the terms mentioned in it. I would advise you to serve notice and take a clean exit. Regards, Ritesh
