I was recruited by an IT company in September 2011. After undergoing three months of training, I was posted in Bangalore in January. Since then, I have been on the bench. It has been over a year now. Initially, I used to report regularly, but later I was informed that I need not report regularly and that I would receive a call for a project if any. Consequently, I stayed at home for four months and received only one call during that time. Recently, the HR department sent me a notice stating that they would take action against me for not having ID swipe records.

Question Regarding Layoff or Resignation

My question is, if they lay me off or if I resign now, would I be required to pay any additional amount apart from the specified amount in the bond agreement since I have not been utilized by the company for over a year?

- You mentioned "undergone three months of training" and "over a year being a bench consultant." Who were you reporting to?

- If the reporting authority asked you to stop reporting until you received a call, was that instruction given in writing or verbally?

- Did you try to reach out to HR for further queries during those four months?

- What kind of call did you receive (Project/HR related, etc.)?

- "HR sent me a notice that they would take action against me for not having ID swipe records." Didn't you feel it was your right to question HR since the reporting authority asked you to stop reporting? Why should they take any action against you as you were just a bench candidate?

- What about your pay/salary—were you on the payroll?

- How have you been paid?

- Why do you think the employer is redundant to lay you off?

- What prompted your thoughts about resignation?

- Can you explain the bond agreement clearly to us?
