Hi Lokesh, I resigned from my last company on 3rd September '12. It was mandatory to serve my notice period of 45 days. Hence, my last working day was 17th Oct '12. However, I have not yet received my salary for the months of September and October '12. I have emailed the HR department requesting an acknowledgment of my email, but they have not responded to my inquiries following my resignation. On my last day, the HR department requested that I sign a no-dues certificate to obtain my relieving letter. I made a note on the certificate stating that I have not received my salary for September and October '12.

Could you please advise on how I can claim my salary, PF, and the procedure for full and final settlement in the state of New Delhi? Should I request my PF before settling my last salary?

Approach the right person in the company. Present your case and get the F&F done. You cannot ask for PF before the settlement. As per the Act, PF can only be withdrawn when you are not joining any company where PF is applicable. Once a PF member, always a PF member. You have to provide a declaration to that effect.
