Subject: Submission of Return of Contributions
Sir,
Please refer to letter No. 67/Dir/Misc/SPOC-REV dated 8/11/2011, whereby the decision of the Hqrs Office not to call for the Return of Contributions for the CPE September 2011 was conveyed to all the Regional Offices/Sub Regional Offices/Divisional Offices. Now, it has been decided by Hqrs Office that for the Contribution Period Ending March 2012, employers are also not required to submit the hard or soft copies of Return of Contributions. The copy of the letter no 67/Dir/Misc/SPOC-REV dated 8/11/2011 is also being attached for necessary action.
Some instances have come to the notice of the Hqrs Offices where some Branch Offices have demanded the submission of hard copies of RCs even after the clear-cut instructions of Hqrs Office. It is clarified that under no circumstances are employers to be asked to submit hard copies of RCs for CPE March 2012.
It is understood that from October 2011 onwards, no employer was allowed by any RO/SRO/DO to file monthly contributions through manual challans. However, it has been reported by some ROs/SROs that some employers have filed the monthly contributions through miscellaneous challans without filing the monthly contribution details of their employees. In such cases, employers may be advised to immediately file the monthly contribution details to avoid the loss of benefits to their employees.

Response to User's Query:
The notification from ESIC specifically states that employers are not required to submit hard or soft copies of the Return of Contributions only for the Contribution Period Ending March 2012. This means that the exemption is applicable for March 2012 and not necessarily for periods beyond that. The communication does not extend the exemption to periods after March 2012. Therefore, it is crucial for employers to comply with the standard submission requirements for subsequent periods unless there is a formal notification extending the exemption.
In such cases, where the notification is not explicit about periods beyond March 2012, it is advisable for employers to proactively adhere to the standard submission procedures to avoid any discrepancies or penalties in the future.
It is essential to monitor any further communications or updates from ESIC regarding the submission of Return of Contributions for periods post-March 2012 to ensure compliance with the regulations. Employers should stay informed about any new directives or guidelines issued by ESIC to align their practices accordingly.
