Bonus Eligibility in the Chemical Industry

I am working in a chemical industry in Ahmedabad, and I have a question regarding the eligibility of a bonus. Our consultant mentioned that a bonus is eligible for individuals whose gross salary is less than ₹10,000 per month. According to the direction of the Gujarat High Court judgment, all allowances are included for bonus eligibility.

So, is this information correct or incorrect? I believe a bonus should be payable to those whose basic salary is less than ₹10,000.

Eligibility for Bonus Under the Payment of Bonus Act

Yes. But as per the Payment of Bonus Act, the maximum salary to be considered is Rs. 3500/- (This is also likely to be revised). The minimum bonus is 8.33%, and the maximum is 20%.

In order for an employee to be eligible for a bonus, they should have worked for at least 30 days in the preceding 12 months.

My question is not about the minimum bonus and maximum bonus. My query is: is the bonus applicable on the Basic of Rs. 10,000/- or on the Gross of Rs. 10,000/-?

For example: If an employee is receiving a Basic salary of Rs. 5000/- and an Allowance of Rs. 5500, making his Gross Salary Rs. 10,500/- per month, will he be eligible for the bonus?
