Hi,

I am Harish. I have been working at my current organization for 2 years now. When I joined, my appointment letter stated that my notice period would be 2 months. However, now that I have resigned and am prepared to serve a 2-month notice, the company is requesting a 3-month notice period. Upon questioning the reason for this change, they explained that in a recent appraisal email, they announced an increase in the notice period to 3 months.

I expressed my inability to serve a 3-month notice as I did not agree to this change in the notice period. Nevertheless, they insist that a 3-month notice is mandatory and cannot be negotiated.

Please advise on how to address this situation. Can I take any legal action to obtain my relieving letter?

Change in the notice period is not fair when it will adversely affect the employees who intend to resign. However, it will be a blessing to those who are terminated or have their services ended abruptly because they will also receive three months' notice or payment in lieu of three months. Thank you for the response. How do you suggest I deal with this issue? I am ready to serve 2 months, but they are demanding me to serve a 3-month notice. How do I deal with this situation? Should I take legal steps?

Legal action will take time and you may not be able to get a proper relieving from the company. Therefore, it is advisable to bring some mediator and settle the issue. Regards, Madhu.T.K

Role of a Mediator in Employment Disputes

A mediator is a person whose word will not be rejected by your boss. An officer of the Labour Department, for example, can be approached. He is the right person to consult even when you proceed legally.
