Do we have any provision which says that an employee may restrict his PF contribution to 6500 only and not on his actual salary?

Do we still have to apply for subcodes in ESIC after the introduction of the Biometric card, e.g., an employer whose employee is working in Chandigarh has to obtain a subcode in Chandigarh?

Dear Friends,

Need urgent feedback here. We are an architectural/interior designing firm based in Mumbai and executing interior projects on a turnkey basis. Our technical staff strength is 6 with 2 partners.

Are we eligible for ESIC deductions by our clients, especially when we subcontract the work to different vendors/subcontractors and do not have any labor under our payroll? Can we forward our subcontractor's PF number to avail exemption from the deductions? Our subcontractor is eligible for PF but not ESIC as they have fewer than 20 employees under their payroll too.

The minimum number of employees required for ESIC deductions is 10 or more. If you are subcontracting to different vendors and the laborers are not on your payroll, their PF and ESIC deductions should be done by the vendor, and the challan has to be submitted by you.

And u should not bother about pf and esic coz max labour should be 10 and in you case there is only 6 labours.. and about pf that will depend on basic pay..

Hi,

I need an official clause/document mentioning that we are not eligible for ESIC deductions as we have less than 10 employees on our payroll and we subcontract our work. In such cases, subcontractor PF/ESIC is applicable and should be a valid document to avoid any deductions. Please note that our subcontractor is registered for PF and not ESIC, and he has provided us a letter to confirm the same.

Hi Rohan,

I think this should solve your purpose. This is the statement from the Employees' Provident Fund Act.

According to Section 1 of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, provisions of the said Act are applicable to establishments (including International Pvt Ltd Companies) having 20 or more "persons" on any day of the year. Even if this number subsequently falls below 20, the Act continues to apply to the concerned establishments. Currently, the requirement of a minimum wage/salary of Rs 7,500 provided under the Employees' Provident Fund Scheme, 1952 (Section 26) is applicable to employees to become members of the Fund, which does not affect the obligations of the employer or the necessity for an establishment to make necessary contributions. In fact, through a notification dated October 1, 2008, some recent amendments have been made to the Act, under which every employer must provide details of the "international workers" employed in the concern in Form IW-1 within 15 days of the notification and make a PF contribution for them as well. I hope this information helps.

ESI is applicable to the establishments having 20 coverable employees under the act. So you dont have 20 coverable employees in both the organisations. For ESI present wage ceiling is Rs.10000/-

ESI section 2.(9) for PF section 2(f) - both the provisions are applicable in the case of contractor labor. When depositing the ESI contribution, the state govt may allot a separate code no for depositing the ESI contribution in his separate code. It is the prime responsibility of the principal employer to deposit the contributions as admissible under the above two acts in his own allotted code.
