Hi all, I have a query regarding PF and ESI. Can an employee be covered under ESI as well as PF at the same time? Can we deduct an employee's ESI contributions as well as PF contributions every month?

ESI & PF are separate statutory requirements. Both shall be deducted as per applicability.

Dear Seniors, I have a query that was raised with my ESI consultant. I am working for a private company, and we are taking work orders from our clients. We have employees to complete the work, for which we pay ESI & PF. Additionally, we have some vendors in the civil and electrical fields to complete certain works. Our vendors do not have ESI & PF formalities because they do not have more than 10 employees working with them.

Our consultant says that we need to deduct ESI & PF for the employees of vendors as well. I am not sure why. It would be great if someone could shed some light on this, please.

I am working at a manufacturing company where 150 employees are employed. All employees are eligible for ESI and PF. However, our management has recently divided our employees based on divisions. Separate ESI and PF Numbers for Each Division

Is it possible to have separate ESI and PF numbers for each division?

Dear Karthick,

Your company, being the principal employer, is responsible for the contractors, daily wage workers, etc., working for you. Hence, you need to deduct the ESIC for employees working for your company. They are automatically covered under your company's ESIC code. You do not need to deduct PF.

No need to change ESIC or PF numbers of your employees. They can continue using the same ESIC & PF numbers. Please ensure that the contribution is paid under the existing ESIC and PF code of your company.

Dear Chitra, Please note that ESIC & PF Codes are for the company. I hope that is clear. A company can have many divisions, but the employees will be covered under the same ESIC & PF code. So, you create the divisions and use divide and rule - the best policy at such a time. It has nothing to do with ESIC or PF.

I believe you are not transferring employees from one company to another. If that is so, the PF code of the company and employee PF numbers will change. As far as ESIC is concerned, only the Company code will change; the employees' ESIC number need not be changed.
