Dear All, I urgently seek your help on the below-mentioned issue.
Issue with Employment Confirmation and Salary
One of my friends worked as a manager in an HR consulting firm. The company is completely unorganized. Upon joining, an appointment letter was issued. Subsequently, all performance criteria and targets were communicated via email from the director's email address.
After some time, an email was sent confirming the employment with a salary hike; however, no written proof was provided, and my friend's signature was not obtained on any confirmation letter. Additionally, no salary slips were issued, and the increased salary was paid by cheque.
Later, my friend decided to resign, and an email was sent to the director stating the intention to resign. The director responded and requested my friend to come for the handover, which was duly done.
Subsequently, my friend has been following up for the completion of exit formalities; however, the management is not responding to any calls or emails. My friend's one-month salary is also outstanding, with management stating it will be forfeited due to the lack of a served notice period.
I advised my friend that since no confirmation letter has been signed, there is no need for a notice period. Furthermore, the previous appointment letter is void as the salary increase is reflected in the bank statement.
Please advise on what can be done in this case.
