Hi,

I appeared for an interview for the position of HR in a well-known hospital. An interesting question that was asked to me was, "What is the process of submitting the PF?"

Based on my knowledge, I believe the interviewer wanted to understand the procedures involved after the collection of PF, including how and where the PF is deposited, and whether it is deposited monthly or annually.

Your suggestions, please.

PF submission is a continuous process. When an employee joins an establishment, you have to submit Form 2 (declaration cum nomination) and Form 5 (return of new joinees). Every month, you have to pay PF dues by the 15th and file monthly returns in Form 12A (return of contributions) along with Form 10 (return of employees leaving the establishment during the month) and Form 5 mentioned above if not submitted separately. Then comes the submission of withdrawal forms of those who left along with their respective Form 3A (Contributions particulars). Similarly, the submission of the annual return in Form 6A along with Form 3A of all employees.

How many days employer can hold a PF withdrawal application with them? Is there any particular rule ? Pls let me know.

The employer is expected to submit to the PF Office the Form 19 and Form 10C of the employee two months after he has left the establishment. However, if he has left the establishment and is leaving India for settlement abroad, then the employer can forward the withdrawal forms immediately without waiting for two months. Similarly, in the case of a woman employee who is leaving the establishment after getting married, the employer need not wait for two months.

Respected Madhu,

I am confused about Form 5 and 10. In my previous company, we sent these forms together but for different months. For example, with the December Form 5, we sent the November Form 10. However, in my new company, we send them together. Who is wrong, my last company, or my current company?

In my previous company, we sent November Form 10 with December Form 5. Now that I have joined another company, they send these forms for the same month.

The contribution of PF and ESI is being deposited into SBI, which is a time-consuming and costly affair in today's time. Can we make representations collectively to the Govt to allow these deposits online, as in the case of Income tax and other indirect taxes? Likewise, taxes of Haryana Govt can also be paid online if permitted by authorities.

I request everyone to consider using this form to apprise the Govt. for necessary changes in the respective rules.

You can send Form 5 showing details of employees who joined during the wage month (i.e., for the return month of February 2010, the wage month will be January 2010) and Form 10 of employees who left during the same wage month (continuing the same example, employees who left during January 2010), along with Form 12A showing the wages and contributory particulars of the wage month (say, January 2010).

Dear Friend,

The answer to this question is just the detailed calculation that we do while filling the PF Challan. Of course, if you had also added the information about Form 3A and 6A, then it would have been much better. I appreciate the suggestion of paying the PF contribution online. I will speak to the Regional PF Commissioner on this issue, who in turn can present the proposal to the Board of Trustees in Delhi. This is the way we can bring about change in the current labor laws.

Hi, PF contributions are collected from employees' and employers' shares and deposited in any State Bank of India before the 15th of every month (in challan). The process involves submitting monthly returns (new employees' and leaving employees' details) and 12 A (challan details) in the concerned PF office either directly or through postal service (please refer to the challan and 12 A model).
