Dear All,

In the interest of public health, the Ministry of Health & Family Welfare issued a detailed Notification dated 30th May 2008, establishing Rules under the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003, to prohibit smoking of cigarettes and other tobacco products. This notification, which prohibits smoking in public places, will be enforced from October 2, 2008. All Members are advised to review the revised Rules, which prohibit smoking in public/private workplaces among other places. A copy of the notification is attached herewith. With the enforcement of the revised Rules, smoking will be permitted on roads and at homes but not in any other places, as the impact of smoking indoors is greater than outdoors.

The salient aspects of the revised Rules are as follows:

(a) Restrictions on smoking apply explicitly to hotels, restaurants, refreshment rooms, public places, etc., including workplaces. Section 4 of the Act stipulates the provision of a separately ventilated smoking room known as the "Smoking Area," with specific regulations for such areas.
(b) The Rules mandate that the owner, proprietor, or manager of all public places ensure no smoking occurs in the restricted areas within their jurisdiction. They must also display a signboard at the entrance of the premises on each floor, including staircases and lift entrances, meeting specific prescribed dimensions (as per Schedule II).
(c) Detailed provisions for the strict implementation of the prohibitory orders have been included.
(d) The establishment's manager is subject to fines for any violations of the smoking prohibition by individuals.
(e) The head of the institution, HR Manager, or head of administration must be designated/authorized to enforce smoking bans at offices and workplaces.
(f) Ashtrays, matchboxes, lighters, or other smoking facilitators should not be provided in the workplace.
(g) Managers must prominently display the name of the contact person for complaints regarding violations of these Rules within the establishment.

Good to see this, but how far is it going to be implemented outside the workplace? How is this going to be monitored? Or is this just another initiative like the one we had for wearing helmets in Chennai?
