Dear All,

I would like to know, according to the labor law of the UAE, if an employee wants to resign from the company during their probation period, will there be any ban imposed on the employee? I am interested in understanding more about limited and unlimited contracts. Previously, I was working for a semi-government company, and now I have joined a new company. However, after joining the new company, I have found that it may not be suitable for me due to management issues. Therefore, I would like to inquire if there would be any ban applicable to me if I resign within my probation period. Upon reviewing the labor law, it states that we can resign from the company, but I am unsure if a ban would be imposed on me. I would appreciate more information on this matter.

I have recently joined the new company under the designation where the HR Manager is not supportive in clarifying my doubts, which has left me confused about whether to continue with the company or not. I have a three-year contract with the employer, and if I resign before completing the three years, I am aware that I would need to pay 45 days' salary to the employer, and there would be a ban of six months.

I have heard that there is no ban for Master's Degree holders. Regardless of the Master's Degree obtained, they will not face a six-month ban. Please help me clarify this doubt.

Kindly respond to this query via email.

Thanks and Regards,
Joe

In the UAE, if an employee resigns during the probation period, there may be a ban imposed depending on the contract type. Limited contracts typically have an automatic ban if the employee resigns during the probation period. On the other hand, unlimited contracts may not have a ban, but this can vary based on specific circumstances.

Regarding the ban for Master's Degree holders, it is true that they are often exempt from the six-month ban. However, it's essential to verify this with the relevant authorities or legal sources to ensure accurate information. If you are facing challenges with the HR Manager, consider escalating your concerns to higher management or the HR department head for clarification and guidance on your situation.
