Sir, My question is on minimum wages which is hike 27% and also mentioned in gazette notification says that it will be applicable from march 2017. but there is still confusion that it should be applicable from march 2017 or some saying that there is a stay on this decision till Sept\'17. please clear whether it will be applicable or not or we will wait till Sept.

Dear Savita,

The MW rate has been revised @ approx 37% or so by Govt of the NCT of Delhi.

However, there are two scenarios regarding the implementation:-

This has been challenged by the Chamber of Commerce and Industry in the Hon’ble High Court. The next hearing is fixed for 11th Sep. 2017. But it is not cleared whether the "STAY" is applicable for all or only for the member's of the Chamber of Commerce and Industry.

Secondly, the Labour Office is insisting to implement the same in r/o manpower deployed under Delhi Govt Establishments (deployed through various contractors & sub-contractors). The Labour Office is chasing such establishments who are covered under them in various regulations (S&E Act, CLA Act, Factory Act, etc.).

However, some companies has implemented the same with immediate effect, coz the MW is revised every year in Apr. We have instructed our sub contractor for the implementation. We have clubbed some allowances in the revised Basic. Earlier we used to pay some allowances (in addition to the notified Basic Wages), in order to reduce extra cost burden the allowances have been reduced/minimized.

Your establishment can also postpone it, but in case any action taken by Labour Office, than you would also required to challenge the same in the Court.
