Dear All,

I need your assistance to this query.
We are using a service of a consultancy which has sourced in a few candidates for us on a contract staffing bases (Not on our company role).
Can you please let me know who is entitled to pay ESI and PF to these candidates and how much. From the employees I have learnt that they are paid only 4000 Rs. a month where as we pay the consultancy 7000 Rs a month.

Please tell me who is liable to pay ... what and how much? (Ex:PF,ESI,PT,TDS,etc...)

Is PF manditory for a pay of 4000 a month? What other payments or benefits are these employees, we as a company and the consultancy liable for?
And does PT, TDS or anything else get into the picture?

Your replies would be of great assistance to me. Kindly assist

Look as per my knowledge PF and Esic both are paid by employees as well as employers.Now as you are the principal employer you have to pay the consultancy the Pf and esic contribution and the service charge as per the agrement.,and the same amount will be deposited by the consultancy to the respective employees pf and esic ac.I am attaching a file for your refference.Hope it will clear your doubts regarding the same.
Now for any doubts regarding the deposit of PF and ESIC amount you can ask for the photocopies of the return submitted against PF,ESIC,P-Tax,and service tax for your future referrence.As well as at the end of the financial year you can ask for form 3a and 6a for PF.

You are principle employer so the liablility of PF, ESIC is naturally & by legally too on the company side.
& off course I think you are making the payments by the cheque or by legal way to consultancy. It is sufficient to prove that those employees are at work in your comapanies premises.

Hi,
As a Principle employer its your liability and responsibility to verify that the consultancy on whose payroll the employees are , paying all statutory dues on time. Every month when they will be billing you , ask them to submit the challan copy of PF , ESIC of the previous month and also returns as and when due and submitted highlighting the names of employees working in your premises. If consultancy is not paying the dues , it will become your responsibilities to pay, so keep check on that. Do it for all contarctors you have , since if you have any inspection you will be on safer side after maintaining proper records. Make seprate file for each contractors with detailed paperwork.
