Sir,
Our is a non profitable registered organisation under societies act, and carring out some programes for HIV/AIDS children. To carry out our program, we have appointed few staff as counceller, ANM nurse and out reach employees.
kindly guide me in regard of applicable of minimum wages act for our organisation. If there is any written rule, kindly attach please.

Dear Vijayakumar,
Any activity partaking the character of an industry would become an industry whether there is profit motive or not and the paid employees therein would be covered by the respective Labor Laws. The societies registered under the Societies Registration Act,1860 or any other similar State Law, if it employs 10 or more number of employees, it is covered by the Payment of Gratuity Act,1972. If its head office or branch offices are situated within the geographical area to which the State Shops & Estt Act applies, then it would be an establishment under the same and hence there would be automatic application of the Minimum Wages Act,1948 too. Therefore, pl refer to the minimum rates of wages fixed by your State Government for employment in Shops and Establishments and implement them to your paid employees according to the posts held by them in the organization.
