Hi Team,
I have resigned my company and joined and they are not ready to relive me without completion of 3 month.
In My Appointment Letter It Is Clearly Mentioned That You Have To Give A Notice Period Of 3 Months Or Pay the 3 Month salary. I already write the mail to the management and HR but they are not ready to relive me so i decided to leave the company without reliving letter even they are not ready to take the laptop so I put the laptop in IT room and mailed to all the person. My boss is not ready to relive me.
I joined the new company in 28 June 2016 now i trying to take my reliving letter and full and final from the last employer .
My question is below-
1.Will It Be Illegal Or Is There Any Other Way To Come Out From This Situation? Can I File A Case Against The Employer?
2. How can i get mu full and final and relieving letter.
3. Whom i write the mail now (I seated at plant but my reporting in corporate a office) plant HR or corporate HR?

Dear,
As you already signed appointment letter where notice of 3 months was cleared mentioned and you left them without serving the notice as per appointment letter, so there is not point to file case against them, infact if they want they can file the same against you.
There is no way out. You have done wrong. Remember one thing and that's an advise from my side, if you leave any company, then prior leaving at-least serve the notice whatever is mentioned in the appointment letter. And prior leaving if you want your notice period to be waived off, then make a request to your HR and reporting head and only on their acceptance leave the company. Always leave any company on a good note. Because you never know when you may need their help in future. So always maintain a good relationship with every employer you work .

Dear Anirudh.
You have not mentioned in your draft, that whether you have given 3 months to the company before relieving. The write up says that you are guilty somewhere. If it is mentioned in Appointment Letter than you have to fulfil the duties of company. Or as HR_ROY told, you should have done the discussion to your HR Head for waiving off the Notice Period by behaving very sensibly. If you would have done this, than it may be that they would have understood it and would have made the provision for your early relieving. Never spoil the relations with anyone in the company. Still it is not a bad situation. You may request to HR Head and tell her/him that please consider my resignation and give me relieving letter and all other stuff which is remaining. By saying "SORRY" and handling the situation sill be good for you. All the Best.

Thanks for your valuable replay.. I already serve the 55 days , I put 5-6 mail for reliving me and full and final after that i didn’t got the relieving . Then i go with the offer.

Hi You can contact a lawyer and send a notice to the company. since there was no response from the company HR team
