A company based at a city at Maharashtra executed separation from employee, i.e. co was sending out me due to closure of

project in which I was working.I got a separation mail also from HR person quoting the same. But When they give relieving

letter they/HR had given that "He has resigned from our organization for Due to Project Closure . His resignation was

accepted and was relieved from his duties effective from-------".

WherasI want to be straight forwarded truthfull to,do not want to have suspicious questions from my future co. So I

requested HR to give as " xxxxx Pvt Ltd could not get business, because of the business-discontinuity we closed

the project in which he was working, thereby, not as a fault of the member we separated him from employee."

I did not get any response from HR, what I shall do to get it done LEGALLY to get the way I want.

Now I am job less,living at and worked at the co's client which is other than the co's base city.i.e. other state.

That is the city where I was working having my ex-co-office; now closed and a top manager is running office activities from his residence in the same city.

Dear Ravi,
It is unfortunate that you got the separation note.
What is not clear is that did you have any clause in the appointment terms relating to separation due to project completion ? I presume that that there was none otherwise you would have mentioned it.
Issue is that as to how important is it for you to have the "resignation" changed to actual reason.
As you will have to invest time and effort to have it changed through court of law.So weigh the advantage if any vis-a-vis time and effort.
In case you want to have the actual reason to be accepted by you employer, be prepared for delay as court cases do not get resolved in days but in years.

I use the presently given relieving letter with reason of resigned, to future cos. But parallely through court I will get it replaced with actual reason. Why because the actual reason of separation is not correct, i.e. even though the project is running, they said closed, just to shuffle people. That reason is not accepted by LAW. More over in the appoint ment letter they mentioned as if they do not want service any more, service will be terminated."do not want service" - is a very blind reason which could not be accepted by law I believe. Can I know your profession in brief - Lawyer or corp HR.
