In general sleeping during lunch time is not misconduct; however it will be considered as misconduct when one exceeds time limit while sleeping at work area, also one must note that this should not be done on a regular basis no matter even if it is lunch time, once in a while is fine!

answer: Can the worker/ staff sleep during the Lunch or Snacks Breaks??. Whether a type of Misconduct? it will depends on the company policies and procedures and if we have any clause of sleeping in the lunch hours and during the snacks time it is a misconduct if it was mentioned in the standing orders of the company

Dear Sinha and all other participants,

It is not a question whether it is a lunch break, or it forms part or not of the work hours of the employee. The question arises, which is the place the employee uses for his sleep during lunch hours.

If an employee sleeps on his office seat or in working chamber, of course that is against the OFFICE/ ORGANIZATIONAL DECORUM, which should not be allowed, as even during lunch time several outsider visitors or even dignitaries may happen to visit the office and see the staff sleeping. That instance goes against the prestige of the oganization and discredits the organization before outsiders. Of course that can be taken as a misconduct. However, that is another thing if the management does not take any notice about that or ignores such instances.

However, if the employee sleeps in the rest room or employee recreation room provided by the organization, that can be exempt.

No. But where and how he/she sleeps can be defined as misconduct, if it creats any nusence.

Sleeping in lunch break is a misconduct according to company rules if it is done in the office or work table. If sleeping is done in canteen or anyother area specified for the same, it is legal. The logical elucidation is the act of sleep is a contagious phenomenon which will act upon all the employees slowly. This results in sluggish and tiresome atmosphere.

Two years ago The Supreme Court of india delivered a judgement on this and clearly said that "Sleeping at work is a gross misconduct & management can terminate the person's job".Although,few Comapanies allow power nap & even provide "Rest rooms" as part of liberal HR policies.But pl.check before "sleeping".In case Company moves gaianst You,You have nowhere to run.

Hey,
If an employee is sleeping in the working area then it is a misconduct of the rules and regulation of the organisation.
In every organisation rest room has provided only for employee benifits if they want to take rest during their break then
rest room is only the place becoz in working area customer dealing,cash dealing etc is happening which can effect the brand of the company .

Hi,
if somebody is sleeps in working area at his seat that will not be acceptable but some time it can be happen that he/she is not feeling well and wants a break that time will be acceptable if there no rest room....
