Thank you for your reply.
Yes u are right....... 12 weeks are = to 3 months, hence its almost 90 days... Any company can give more that will be their policy..
Extra 30 days also one lady worker can avail with proper medical documents...
Hence, I think, who ever is following this discussion has understood that if it is a factory or any other establishment, having lady workers in their pay roll / wored 80 days without any break (except weekly off) is entitled for Maternity Leave with pay irrespective of ESIC exists or nor...

Mr. Lingaraju,
You have got all the advice needed on how the leave is to be granted under the Mat. Benefit Act, but the vital point here is that if your factory is not covered under the ESI in such case it becomes mandatory for you to cover all your employees under the WCA, verify this and make sure you are not on the wrong side of the law.

More clarifications.MB Act will be applicable to only women who are not covered under ESI Scheme..Both will not applicable to a person at a time.EC Act will not be applicable to all employees not covered under ESI.It is applicable only to the employees defined as such under the Act in the employment specified there in .Many employees falls outside this definition.

Dear Members, Yes, Female employees are entitled to maternity benefit under this act provided the female employee has worked for 80days in the factory/establishment.
