Dear Seniors,
We are an out sourcing firm, one of our client's factory has situated in Non implemented area as per ESI. So ESI had given a notice stating that we are not supposed to pay ESI for that location employees. After that we have stopped deduction of ESI amount from Employees. Our client has taken A Workmen Compensation policy for that particular premises.
Now one of our contract employee family member is facing health issue. And he is insisting us to bear those expenses. how far an Employer is liable in above said case.

Dear Ravi: Since there is no ESI coverage, there is no statutory responsibility for providing medical facility in any form. Employee Compensation Act has no provision for extending medical facility to family members. Regards
