I am working in Private Company in HR Dept. . There is one staff lady who is pregnant & her due date for is in Oct 2017. She also covered in ESIC in January after new amendment for ESIC wages Rs. 21000.
My concern is what amount shall she get for ESIC benefit.
What is procedure for company & ESIC benefiter - Whether she get full salary in maternity leave.
Can company will pay for the same. Give me new amendment act.

1. Dear member, the question of eligibility of a woman insured person for maternity benefit is a question of fact and I think, only the issue can be decided and confirmed by the concerned Branch office Manager of ESIC to which the said woman insured person is attached. Therefore, it will be more better if you/concerned person may contact the said office.
2. The concerned branch office of ESIC will make payment of maternity benefit, ( if the said person is eligible) on the basis of medical certificate she will obtain from ESIS dispensary/hospital. It will be more better if you may go through the procedure as may be available on the website of ESIC or as may be advised by ESIC Branch Office.

Dear Kavita,
As far as I know, the maternity benefit's from ESIC can be claimed by an female employee only if her contribution period is for 02 years or more. Till that time Maternity Benefits are not applicable to her from ESIC.
For more clarification you need to visit your local branch of ESIC and If they deny for the same then the Maternity Benefits has to be borne by the company only.

Maternity benefit can be claimed from ESIC, if the member pays contribution for a period of not less than nine months.in this case, ESIC will not pay maternity benefit. Company has to pay the same provided she worked for 80 days during the preceding period of one year
