HR should, irrespective of the short notice, complete the necessary formalities of issuing the relieving letter. To be on the safer side, even if the employee does not ask, make it, sign it, and file it in the employee's file.

Dear Tapas,

Under the current labour laws, there is no such express provision as you are asking for. However, one can always file a civil suit against the company to obtain the experience certificate along with some damages. The choice is ours: whether we want to practice fair personnel policies and be seen as fair employers, thus building a brand image for the company or not.

Dear Member, It is moral duty of the company to give Exp & Releiving letter to its out going empolyees and employee should ask for the same before he leave the company. Vikas Jain

what if the exiting employee is breaking a bond? will he still be given the relieving letter and an employment certificate?? Please reply. its kind of very urgent

Yes a company an give a relieving letter and a certificate to the employee who did not serve the bond period after his/her completion of no dues formailities
